Denver, Colorado Attorney: Intellectual Property Rights
I focus my practice on the following areas:
I am committed to obtaining protection for the creative efforts of my clients, whether product names, logos, software, business materials or art. Relying on common law protection (rights without formal registration) can limit your protection and create problems. The registration process can be complex and challenging, but it is important. I will assist you with clearing prospective marks and logos, drafting and prosecuting the applications through appealing a rejection (if necessary). After securing a trademark, I can assist you with satisfying the requirements to keep the registration in effect (Section 8 & 15 Affidavits and renewals). While you utilize your creative abilities, I will get through the bureaucracy when your intellectual property rights are at stake. I can also assist with confidentiality agreements and trade secret protection programs
Whether seeking a software license or negotiating a contract for software or website development, you should hire an experienced lawyer to help you secure your intellectual property rights and make sure you own what is created. I have advised software and web developers, as well as companies licensing software or technology for internal and or commercial purpose. The Internet, online business, domain name, digital media and open source software/freeware present unique issues. If you hire a third party to create something for you, without a written agreement securing your intellectual property rights, there may be issues of ownership. As your attorney, I will assist in all aspects of software and technology licensing and of securing intellectual property ownership and protection.
The challenge of constantly pushing creativity can be hard enough on an artist. The Internet has made it easy to misuse creative content. Whether music or visual art, the work should be protected to the greatest possible extent. Registration provides presumptions and remedies not otherwise available. Artists and galleries face unique business issues. As your art law attorney, I will take on the details of securing a copyright, trademark, or negotiating a contract while you continue to do what you do best as well. My goal is to protect what you have worked hard to create. I have represented many artists and art galleries and can help you with legal and contract matters that will otherwise distract you from the creative process.
